Rejecting Saigal's plea, ED can take Anuvratar's bodyguard to Delhi for questioning

New Delhi: ED wins again in court. Delhi High Court allowed Saigal Hussain to be brought to Delhi for interrogation in cow smuggling case. Anubrata Mandal's bodyguard filed an application in the court not to bring him to Delhi for interrogation. But on this day, the application was rejected by the Delhi court. The bench of Justice Sudeep Kumar Jain informed that the ED can bring Saigal to Delhi for 6-7 days for interrogation in the case of cow smuggling.


Anubrata Mandal's bodyguard Saigal Hossain has been arrested by the Central Investigation Agency (ED) in the cow smuggling case. ED has decided to take Saigal to Delhi for the sake of investigation. Officials of the Central Investigation Agency want to interrogate them in their custody in Delhi. ED has filed an application in Delhi's Rice Avenue Court. The hearing of that case was today.


On this day, the hearing went on for about 1 hour in the Delhi court. Justice Sudhir Kumar Jain said, "If Saigal is brought to Delhi for a short time for the purpose of investigation, then what is the problem?" While the ED wanted to take Saigal to Delhi for at least 15 days on ECIR and other issues, the judge fixed 7 days for the sake of investigation. After the hearing, the court ordered that Saigal Hossain, the bodyguard of Anubrata Mandal, can be brought to Delhi for 7 days for questioning.



According to the court order, the custody will not be changed. FIR will also not be transferred. ED can take Saigal Hussain to Delhi only for questioning.


During the hearing on this day, Saigal Hossain's lawyer Manu Sharma brought his client to Delhi and told about several conditions for the interrogation. The court said that Saigal will be brought to Delhi only for interrogation and not custody. Saigal cannot be interrogated continuously. ED can conduct interrogation for two hours every day of seven days. This time will be 11 am to 12 pm. After a break of a few hours, the interrogation can be repeated for 3 to 4 hours.


According to sources, Saigal's lawyer is thinking of filing an appeal in the Supreme Court against this judgment of the Delhi High Court.


The ED also requested the lawyer to be present during the interrogation so as not to create emotional pressure on Saigal during the interrogation in the cow smuggling case. According to the court order, the IOA officer and Saigal's lawyer will be present during the interrogation in addition to the ED officer. Even if present in the same room, the lawyer must remain at a certain distance, so that he cannot hear any questions.


ED first applied to the Asansol court requesting to take Saigal into their custody and interrogate them in the cow smuggling case. But at that time the judge dismissed the application citing procedural errors. Later, ED filed a case in Calcutta High Court. But even there, the Central Investigation Agency was hit in the first phase of the hearing. Justice Tirthankar Ghosh asked why a case was filed in Calcutta High Court to take Saigal to Delhi? Finally, the Central Investigation Agency approached Delhi's Rouse Avenue Court to question Anuvrata Mandal's bodyguard in their custody.


ED claims that Saigal Hossain, the infamous bodyguard in the cow smuggling case, has a lot of information, which is very important for this investigation. That is why ED wants to take Saigal into their custody. The case was filed by the ED in Rouse Avenue Court last Saturday for interrogation in Delhi. The hearing of that case is today.


Incidentally, Saigal Hossain filed a caveat earlier to save himself. The caveat means that if the ED approaches the Supreme Court, then the Supreme Court will have to hear Saigal Hossain's statement.
